These Terms of Service ("Terms") govern your access to and use of Core Calendar (the "Service"), developed and operated by Trevor O'Donnell ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you don't agree, please don't use the Service.
You must be at least 13 years old to create your own Core Calendar account. Children under 13 may be added as family members only by an adult account holder, who is responsible for that child's information and activity within the family account. You're responsible for keeping your login credentials confidential and for all activity that happens under your account.
Core Calendar — including its name, logo, source code, software architecture, visual design, user interface, and all other content and materials that make up the Service — is the exclusive property of Trevor O'Donnell and is protected by United States and international copyright, trademark, trade secret, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.
License to you: subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial, family-organization purposes.
What you may not do: you may not, and may not permit or assist anyone else to — (a) copy, reproduce, distribute, publicly display, or create derivative works based on the Service or any part of its source code, design, or content; (b) reverse-engineer, decompile, disassemble, or otherwise attempt to derive or reconstruct the source code, underlying ideas, or algorithms of the Service, except to the extent this restriction is expressly prohibited by applicable law; (c) remove, obscure, or alter any copyright, trademark, or other proprietary notices; (d) use the Core Calendar name, logo, or branding in connection with any other product or service, or in any way likely to cause confusion; (e) use bots, scrapers, or other automated means to access, copy, or extract any part of the Service; or (f) rent, lease, sell, sublicense, white-label, or otherwise commercially exploit the Service, in whole or in part, without our prior written consent.
We take unauthorized copying and reverse engineering seriously and reserve the right to pursue all available legal remedies — including injunctive relief and damages — against anyone who violates this section, in addition to immediately terminating their account.
You and your family retain ownership of the calendar events, lists, recipes, meal plans, and other content you create in the app ("Your Content"). By using the Service, you grant us a limited, worldwide license to host, store, transmit, and display Your Content solely as necessary to operate the Service for you and the family members you share it with. You're responsible for Your Content and for having the right to share it, including anything you enter about another family member.
You agree not to use the Service to: violate any law or the rights of others; upload or share unlawful, abusive, or infringing content; attempt to gain unauthorized access to the Service, other users' accounts, or our systems; interfere with or disrupt the integrity or performance of the Service; or impersonate any person or entity.
We respect the intellectual property rights of others and expect users of the Service to do the same. If you believe content uploaded or shared through the Service (such as a profile photo) infringes your copyright, you may send a written notice to our designated DMCA agent that includes: (1) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (2) identification of the copyrighted work claimed to have been infringed; (3) identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it; (4) your name, address, telephone number, and email address; (5) a statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Our designated DMCA agent can be reached at: [DMCA Designated Agent name, address, and email — to be filled in once registered with the U.S. Copyright Office].
We will respond to properly submitted notices in accordance with the Digital Millennium Copyright Act, which may include removing or disabling access to the reported content and, in appropriate circumstances, terminating the accounts of repeat infringers. If you believe content was removed in error, you may submit a counter-notification meeting the DMCA's requirements to the same address.
The Service can connect to third-party calendar providers (such as Google Calendar or Outlook) at your choice. Those integrations are governed by the applicable provider's own terms of service, and we're not responsible for their availability, accuracy, or content.
Core Calendar offers optional paid subscription tiers with additional features. Paid subscriptions, where offered, are billed through the Apple App Store or Google Play Store, renew automatically until cancelled, and are subject to that platform's own payment terms. You can manage or cancel a subscription at any time through your App Store or Play Store account settings. Except where required by law or platform policy, payments are non-refundable.
You may stop using the Service and delete your account at any time from Profile → Delete Account. We may suspend or terminate your access to the Service if you violate these Terms, including the Ownership & Intellectual Property section above.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SYNCED CALENDAR DATA WILL ALWAYS BE ACCURATE OR UP TO DATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100.
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles.
Informal resolution first: before filing any claim against us, you agree to first contact us at the email below so we can try to resolve the dispute informally. Most concerns can be resolved this way.
Agreement to arbitrate: if we can't resolve a dispute informally, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court — except that either party may instead bring an individual claim in small claims court. Arbitration will take place in Texas or, at your election, remotely by video or telephone conference.
Class action waiver: any arbitration or proceeding will be conducted only on an individual basis, not as a class, consolidated, or representative action. Neither you nor we may bring a claim as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
Jury trial waiver: you and we each waive any right to a jury trial for any dispute covered by this section, to the fullest extent permitted by law.
Right to opt out: you may opt out of this arbitration agreement by sending written notice to the email below within 30 days of first agreeing to these Terms, clearly stating that you decline to be bound by this arbitration provision. If you opt out, this arbitration section won't apply to you, but the rest of these Terms will still apply.
This arbitration agreement is governed by the Federal Arbitration Act.
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you within the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
